Reservations Rentals Agreement

Reservations

Any reservation is only final once the reservation deposit has been collected by Lowerys Vacation Homes (LVH) and final confirmation has been issued. The final booking confirmation will show arrival date, number of night's stay and departure date. Guests are advised to check this information for any discrepancies or amendments. Guests must notify LVH of any discrepancies within 24 hours. Your confirmation will include a booking reference number. Please refer to this number in any communication. LVH will hold the person whose name appears on the reservation responsible for all payments, damages, theft and all other responsibilities of the agreement. By making a reservation you automatically agree to our terms and conditions.

Deposits

All bookings require a deposit of $250 or 25% of the total booking, whichever is the higher, per reservation. This deposit is non refundable (see cancellation policy below) and immediately subtracted from the total booking amount leaving the balance to be paid on its due date which is 30 days prior to arrival.

Deposit and Methods of Payment

We accept all major credit cards (Visa, MasterCard, Discover and American Express) as well as US money order or bank fund transfer. The guest is responsible for any costs or fees of such transactions. Reservations over the internet via our website are transacted over a secure line (https). All reservations via our website will require credit card details from the guest. In this case the guest agrees and understands that their credit card will be charged for the deposit or funds that apply to the reservation unless agreed otherwise by LVH in writing. Your outstanding balance will be automatically charged 30 days prior to your arrival date.

LVH confirms that no information provided by tenant will be passed onto third parties for marketing purposes.

Cancellation Policy

A non refundable deposit is required upon reservation. The remaining balance is paid 30 days prior to arrival. Our cancellation policy is as follows:

  • If a guest wishes to cancel their reservation 30 days or more prior to arrival then only the non refundable deposit will be retained.
  • No refunds are given on reservations cancelled less than 30 days prior to arrival.
  • All cancellations must be notified in writing and the day of receipt of the cancellation will apply as the effective date regarding the cancellation date and charges.

Cancellation insurance is offered and is optional. Cancellation insurance may refund your deposit as well as balances paid in most cases when the renter is unable to reach their destination or vacation unit due to circumstances insured under the terms of the policy.

We reserve the right to cancel any reservation made under false pretences or if a group exceeding the maximum legal occupancy of the home or for other legal reasons.

Changes to Reservation

Upon request and wherever possible LVH will make minor changes to the reservation at no cost to the guest. The guest understands that changes to date/or upgrades may incur additional cost according to the price category of the home and/or applicable seasonal rates. Unless specifically agreed by LVH in writing, our cancellation policy will apply for all changes. All changes will remain at the discretion of LVH. Our homes are privately owned and located in residential areas. Please do not plan large parties that exceed the number of people allowed in each home. If you are planning a family gathering then please let us know and we will try to accommodate the number of guest in several closely grouped homes. If a specific home is not available for reasons beyond our control then LVH reserves the right to move the guests to a home of equal value or higher at no charge or cost. However, due to the individual nature of our vacation homes LVH cannot guarantee that the facilities offered will be identical.

Facilities on Arrival

The properties offered by Lowerys Vacation Homes are for short term rental and are provided on a self catering basis. LVH will provide complimentary toilet tissue, starter soap etc. Once these items are used it is the guest's responsibility to replenish them. LVH are not responsible for changes in furnishings, bedding arrangements and equipment made by the homeowner.

Damage Liability Waiver

LVH are aware that accidents do happen. A small charge is made on each booking to cover the little accidents that may occur. The booking confirmation will include a charge for (DLW) to cover the guest and his party for those small accidents that happen. Please note that the DLW does NOT cover the guest and their party for damage (other than of a minor nature), malicious damage or theft. The assessment of damage and the remedial costs will be entirely at the discretion of LVH.

Limitation of Liability and Insurance

Guests and their party are recommended to take out adequate travel insurance. LVH, the owner and the property cannot be held responsible for any accidents, theft, illness or damages that may occur to the guest or their party. It is the guest's responsibility to protect the property and its contents against damages, theft or loss. We ask our guests to occupy the property in a quiet and dignified manner to obey local rulings and state laws. Smoking is forbidden by law in any rental home. Most owners allow smoking on terraces, patios or generally outside the area. Pets can only be allowed in certain properties and only upon request in advance.

In general, the maximum occupancy of any vacation home is equal to two persons per bedroom. Dependant upon the individual home this can be increased by an additional two persons. Please check with our Reservations dept. Guests will be removed immediately if found non compliant to this ruling. All properties are under strict regulations under the hotel/motel registration law as well as fire department rules and others. Tenants who do not comply with these rules will be removed from the premises immediately subject to forfeiture of the rental and costs.

Each of the properties offered by Lowerys Vacation Homes has a guest information guide. It is the responsibility of the guest to read the guide upon arrival at the property. The guest is required to ensure that they have read and understood the contents and advice given. LVH will provide additional information and advice upon request on the assumption that the guest has initially read and understood the comments in the Guest Information Guide.

Mechanical Concerns in Vacation Home

If something in a home breaks down due to a Mechanical Failure, Lowery’s must be notified and service will be called to get the situation rectified in a timely manner. LVH cannot be held responsible for things in the home that break down due to a Mechanical Failure. LVH or representatives instructed by LVH may enter the property at any time for the purposes of maintenance issues and security. LVH will provide notice to the guest prior to gaining access to the property provided such notice is possible. LVH do not accept liability for the failure of a pool heating pump to provide adequate heating where the outside temperature falls below 55 degrees Fahrenheit. Most pool heating pumps are set by the manufacturer to operate at air temperature levels of 55 degrees or above. Failure of the pump to provide adequate heating due to that reason is regarded as an act of nature and therefore no liability is accepted or refund given.

Complaints

Any complaint regarding the property, services, damages or missing items etc. must be reported IMMEDIATELY to LVH in writing. LVH can only endeavour to find an appropriate solution to such issues if the complaint is registered. All complaints made after the departure date cannot be considered.
